  • What are the differences between LUBELL & ROSEN's Pre-Paid Legal Defense and Legal Defense Insurance?

    1. When you purchase Legal Defense Insurance, you are buying insurance and they hire attorneys. With LUBELL & ROSEN, you are hiring the attorney's directly. There is no "middle man." LUBELL & ROSEN's "Pre-Paid Legal Defense" is simply putting an attorney on a permanent retainer.
    2. An Insurance Company does not hire attorneys until a case is pending. With LUBELL & ROSEN, Doctors get to meet with Lubell & Rosen immediately.
    3. Legal Defense Insurance limits your coverage to $100,000 per case. LUBELL & ROSEN's coverage is unlimited. There is no dollar maximum.
    4. Legal Defense Insurance provides no asset protection advice. LUBELL & ROSEN includes unlimited asset protection.

  • Does Asset Protection always work?

    Usually, but not always. Unfortunately, it is sometimes impossible to protect all of a person's assets. As one becomes more wealthy, the harder it is to protect one's assets. Furthermore, even if the doctor's assets are adequately secure, it may place unwanted restraints on the doctor's life. Additionally, a judgment in Florida is valid for 20 years and can be renewed for an even longer period of time. Thus, even if a doctor is judgment proof, a judgment creditor may simply wait the doctor out. When the doctor gets divorced or dies, the creditor goes after the assets, and often collects - with interest. Furthermore, as times change new laws could be passed that change the status of assets previously thought to be secure. Asset protection is a good deterrence, but it should never be considered perfect protection.

  • Do I need to be worried the "three strikes" rule?

    Yes! On November 2, 2004 the citizens of Florida passed Ballot Amendment 8 (Article X, Section 20.) Pursuant to the terms of the amendment, if a physician is found liable for malpractice three times during his career, his medical license will be revoked. The amendment places a physician's license in the hands of a jury and puts plaintiff's lawyers in a position to wield tremendous pressure against the physician. Although the Florida legislature has neutered the amendment to some degree, doctors must still be wary of this law.
